Hite is already serving 30 years in the Indiana Department of Correction for causing an Oct. 16, 2009 car crash that claimed the lives of two passengers in his car, Amber McMillan and Nicholas White. Court records indicate Hite was fleeing from police when his Mustang struck a tree east of State Road 23. His speed at the time of the crash was 124 miles-per-hour.

Hite appealed his felony resisting law enforcement convictions, but they were recently uphled by the Indiana Court of Appeals. The court cited Hite’s history of criminal or delinquent behavior and illegal drug use and a recent probation violation in denying his appeal.
