On-Site Sewage Ordinance Approved by Marshall County Commissioners

The Marshall County Commissioners approved a on-site sewage disposal ordinance during their meeting last week.

The ordinance discussed the design, construction, installation, maintenance and operation of on-site sewage disposal systems located in the county. The purpose of the ordinance is to provide standards to eliminate disease and health risks in the utilization of this equipment.

The ordinance outlines what accounts as sewage, the minimum size of a septic tank, construction, and failure of a septic tank. A permit must be granted before a septic tank can be installed on any property and an inspection will be conducted once construction has taken place. The on-site sewage disposal unit shall be regularly serviced as required in the operating permit.

If you are in violation of the ordinance, you will be served with a written order either in person or by certified or registered mail by the county board of health or the county health officer. You could be punished for the first offense with a fine of not more than $500 and $1,000 for the second and each subsequent offense.

The ordinance is available to review in the auditor’s office and in the office of the health department.
