Ordinance to Regulate Public Nuisances on Private Property Addressed at Winamac Town Council Meeting

The ordinance book for the Town of Winamac has been updated and council members considered a quote for the upgrades submitted by the company American Legal Publishing during their meeting on Monday.

Clerk-Treasurer Melanie Berger said the company updated the book to include ordinances spanning from July 16th, 2016 through December 31st, 2017. The quote provided by American Legal was for $1,985. Members voted unanimously to approve the quote.

Additionally, Winamac’s Town Council members are anticipated to consider an ordinance pertaining to public nuisances on private property in the near future.

Town Attorney Justin Schramm noted that the town of Monterey was having some consistent issues prior to implementing a similar ordinance last year.

He told members that it is common for municipalities to adopt an ordinance that regulates nuisances on private property such as grass height, trash and debris in yards and any additional “eye-sore” related concerns. He added that procedures can be included that addresses warnings, consequences and the appeal process.

Schramm noted that a resident came in to his office to discuss trash around town and there was a citizen comment submitted during the meeting about a certain cluttered property.

The citizen’s comment dealt specifically with a vehicle complaint and Councilman Alvin Parish mentioned that there is an existing ordinance that specifically deals with that. Councilwoman Judy Heater added that the proposed ordinance would be able to address some of the additional concerns.

With the council members indicating that such an ordinance would be beneficial, Schramm is now vested with drawing something up for council’s consideration at a future meeting.
