Winamac Town Council Considers Request to Vacate Water Street

A request to vacate an unused easement in Winamac was considered during last Monday’s Town Council meeting.

Town Manager Brad Zellers told the council members that Funeral Home Director Jon Frain contacted the office about an easement that he and neighboring property owners would like to have vacated.

Zellers provided some insight about the location, “There’s an easement behind the funeral home, the property he lives in, the house behind them and the house to the north of Jon Frain. The easement is called Water Street, it’s kind of on the hill and they would like to vacate that.”

Town Council President Tom Murray asked why the request is being submitted. Zellers mentioned that one of the property owners is interested in utilizing the extra space to extend a deck and there are some potential other uses planned.

The town manager also noted that the easement is unused by the town and the process would be conducted at no cost to the town. The easement would be evenly divided amongst the interested parties.

Members voted unanimously to allow the unused easement to be vacated.

Town Attorney Justin Schramm noted now that the town council has provided permission to carry forward with the vacation, an ordinance to officially vacate the area will be drawn up and considered at their next meeting.
