Plymouth Man Sentenced on Battery Charge

A Plymouth man will serve time on home detention after pleading guilty in a plea agreement to an amended Level 5 Felony charge of battery resulting in serious bodily injury.

Nickolas Lozzi, 35, told Starke Circuit Court Magistrate Jeanene Calabrese that on Aug. 24, 2016, he heard the victim characterize him in such a way that made him lose his temper and hit the victim several times, causing serious injury.  The victim stated in court that he had to have steel plates in his jaw and false teeth following the incident. 

Lozzi apologized to the victim and the victim agreed to the terms laid out in the plea agreement. 

Defense Attorney Nathan Pearson noted that since that incident Lozzi has not had any legal issues.  He’s gainfully employed and has eliminated negative influences in his life.  Lozzi has also been clean and sober for a while now and made the effort to become a productive member of society. 

Magistrate Calabrese stated that the crime was serious in nature, but agreed to accept the plea agreement negotiated between Pearson and the Starke County Prosecutor’s Office. Per the terms of the plea agreement, Lozzi was sentenced to six years in the Indiana Department of Corrections with two years suspended to be served on probation.  The executed portion of his sentence was permitted to be served on electronic monitoring through Starke County Court Services.  He will also need to attend programs associated with anger management.  A no contact order remains in place throughout the duration of the sentence.
