Pulaski Commissioners Approve Joint Prosecution Agreement for Opioid Litigation

Pulaski County continues to work with other government entities on a class action lawsuit against opioid manufacturers and distributors. Indianapolis law firm Cohen and Malad is leading the effort, on behalf of several counties and cities around the state.

As part of the process, the Pulaski County Commissioners have agreed to sign a joint prosecution agreement, at the recommendation of County Attorney Kevin Tankersley. “This just is an agreement that we will exchange necessary information about damages that have come to this county and their counties, so the attorneys can compare and contrast and come up with estimates of what costs have been, and that by doing so, we may have to exchange some information,” he told the commissioners Monday. “We may get information from them that could be potentially confidential and we could give information to them that could be potentially confidential, and we agree to all keep it confidential.”

The board of commissioners voted to authorize its president Kenny Becker to sign the document. Tankersley said several of the lawsuit’s other participants have already signed on.
