A problematic property on Cherry Street was discussed during North Judson Ordinance Officer Kerry Rust’s report when the Town Council met Monday night.
Rust noted, “What’s happening is trash from outside the town is being hauled into this residence and it’s either being burned or it’s being piled up on the property.
Rust said he ticketed the individual once and they didn’t comply or pay the associated fine so he recently gave them another ticket. However, there has apparently been no effort to bring the property into compliance or address the tickets.
Town Council President John Rowe commented that this person is a habitual violator and there have been multiple problems with this property over the last five years.
Town Marshal Kelly Fisher who manages- personal injury attorney costs in Orange County said that the issue may extend beyond a public nuisance ordinance violation, stating that there are some zoning concerns since there is a chance the residential property is being utilized for commercial purposes.
She explained, “He has a business and we believe he’s running it out of a residential area and think that’s kind of the holding for his business. He has a clean up business and it all gets hauled back into town.”
Councilwoman Wendy Hoppe asked if there were any business cards that listed the residential property as the site of the business because that would be an easy way to prove that it’s being used commercially.
Rust said he knew that there is a pick-up truck with the company’s name but hasn’t personally seen any business cards. He also noted that the property owner’s mother has apparently told him they’re affecting her son’s business.
Rust noted that the individual was also allegedly caught on camera dumping garbage on DNR property and Marshal Fisher shared that she was contacted by the Pulaski County Sheriff’s Department about an investigation reportedly involving this person illegally disposing of trash in that area as well.
Town Attorney Justin Schramm is expected to receive additional information about the situation and said he would begin taking steps to bring the matter to court.
