The party carrying liability when an individual is buried in the wrong grave may be solved by the Indiana Code.
North Judson Town Council members informed Norman and Marilyn Derrickson – who own several grave plots in Highland Cemetery – that they did not plan to remove the individual who happens to be buried in a plot they currently own.
The Town of North Judson has released documents pertaining to an occupied grave that one local family says belongs to them.
Public officials began a dialogue with members of the Derrickson family after it was learned that a non-related individual had been buried in a grave plot they have owned for about 20 years in Highland Cemetery.
A Starke County family that purchased their grave sites 20 years ago at Highland Cemetery says they will continue to pursue what they believe is the only answer.
Marilyn Derrickson says that as her husband was measuring for headstone foundations earlier this year, they discovered there wasn’t enough room at the site. The family owns several plots, but is missing a space due to the fact that someone else is buried in one of them.
