31-Year-Old Oversight Resolved at North Judson Town Council Meeting

The North Judson Town Council took one last step to address an unresolved request from the 1980’s during their meeting Monday night.

The “ordinance vacating an alley” passed on third and final reading. It relinquishes the town’s ownership of a 16-foot alley between Dahlke and Lyle Streets. The vacated alley will now be evenly divided between neighboring property owners.

At a meeting in April, former town council member Tim Cummins alerted the current council members that necessary steps had been taken to vacate the alley more than 30 years ago. However, he said while attempting to have his land surveyed, he was informed that the alley still belonged to the town.

Documentation submitted to the town officials shows that the Plan Commission held a public hearing over the matter and approved the request in December of 1986. Meeting minutes from January of 1987 show that the Town Council also permitted the vacation. The reason alley was never officially vacated is because the documentation never made it to the Starke County Recorder.

Clerk-Treasurer Andrew Rowe said the ordinance approved Monday night will be forwarded to the recorder and the auditor this week to ensure the matter will be officially documented this time around.
