Oral arguments in an appeal concerning the former City Tavern Building in Culver are still set to occur on Monday, Oct. 28.
Culver Town Attorney Jim Clevenger told the city council members this week that even though the building was destroyed in a fire two weeks ago, it is still deemed an unsafe structure and the owner continues to appeal the initial determination of that designation.
The Town of Culver filed court paperwork last year in order to address the issues that plagued the former City Tavern building. According to the Affidavit filed in court in the matter, the building was unoccupied for four years and it previously suffered from a myriad of different issues. It was appealed by Scotty Van Hawk and the 27 Group, LLC.
The hearing is on Monday at 1:30 p.m. ET at the Eugene and Marilyn Glick Indiana History Center in Indianapolis. The scheduled panel members are Judges Riley, Robb and Bradford.
Clevenger noted that the reason the hearing was moved to a larger facility is that a group of retired professionals including attorneys, doctors, architects, and engineers will observe the hearing. Over 100 people are expected in that group alone, along with a former Supreme Court Justice and officials and residents from the Town of Culver. No comments will be taken from citizens.
