The North Judson Town Council members were presented with an ordinance last week that would approve a petition for the vacation of a public roadway.
The council members previously held a public hearing concerning a request from Thomas DeCola to vacate two roads: Willow Street and Oak Street. The roads were never developed, but platted, and with DeCola’s plans to create a cul de sac with six lots in the area for possible future development requires the vacation of the roads. The property owners would split the property vacated.
There was concern with utilities in the Willow Street area where any future developments would make it difficult to access mains and lines for any maintenance by the town’s utility employees.
In the end, the council unanimously approved the request to vacate Oak Street in that area, but denied the vacation of Willow Street.
During last week’s meeting, an ordinance outlining that action was unanimously approved by the town council.
It was explained by Clerk-Treasurer Andrew Rowe that DeCola asked if he could enlist the services of the surveyor and an engineer to present the replat to the Planning Commission and the town council. When the Planning Commission met and looked at town code it does stipulate that the surveyor and a registered engineer with the state should work to replat the parcel for approval.
With that explanation, the town council agreed all requirements should be met concerning those next steps in the process.
