Knox City Attorney David Matsey will narrow the focus of the proposed dumpster ordinance before the city council approves the second reading.
The city council members last night reviewed the plan commission’s recommendations for the proposed ordinance. The commission members had issues with the definition of a dumpster and how the document would apply to the business sector of the city. They also felt that the time limits in the ordinance conflict with one another.
The Knox City Council is still gathering information about dumpster regulations before drafting an ordinance to govern their placement within the city limits. City attorney David Matsey gave the council copies of policies from other communities to review. Knox City Attorney David Matsey is working on a Memorandum of Understanding between the city and Deb McIntire and between the city and the area churches that will be a part of serving free meals out of the Nancy J. Dembowski Community Center in Knox once a week beginning next year.
There will no rental fee associated with this endeavor.
Knox City Attorney David Matsey has made Clerk-Treasurer Jeff Houston aware that a more formalized process has to be used for water disconnect in the city. As it is now, residents can be up to two months behind on their water bill before a disconnect is performed.
According to a court case from Evansville, due process has to be followed before the disconnect. In other words, a resident would have the right to have a hearing before the disconnect occurs.
Matsey said the hearing could be held before the Board of Public Works to satisfy the court decision. A process will be created by the attorney and Houston on this matter.
Information about the case was sent to the city by the Indiana Association of Cities and Towns.
Knox is one of 50 municipalities named in a federal lawsuit. Kevin D. Miller, who was subjected to a K9 drug search of his person and car in Marshall County last year, has brought suit claiming that dog and all trained by Vohne-Liche Kennels are unreliable. Miller claimed that the dog falsely detected drugs in the car, and in the process of searching the vehicle traumatized his wife. He had initially been stopped for a traffic violation.
