North Judson Man Sentenced to Eight Years in Starke Circuit Court

 
 
A North Judson man pleaded guilty to the charges against him and received a discretionary sentence in the Starke Circuit Court yesterday afternoon. Henry Allen, 53, pleaded guilty to a charge of Criminal Recklessness with a Deadly Weapon, a Class C felony, and was sentenced to eight years in the Department of Corrections.

Henry was arrested in September 2012 after a bullet fired from his gun went through the bedroom window of his neighbor’s home and grazed a young girl’s back. Donnie Greer told police that shortly after midnight he heard a crash in his daughter’s room and when he went to investigate he found a bullet hole in the window and his daughter injured.

Plea Agreement Rejected for Repeat Offender

Starke Circuit Court Judge Kim Hall rejected a plea agreement for a repeat offender.

Christopher Webb, 26, had previously pleaded guilty in a plea agreement with the state on a charge of Burglary as a Class C felony. He allegedly broke into a storage locker and stole a Honda motorcycle in September of last year. The incident also reportedly resulted in damage to the motorcycle.

Kozecar Sentenced to Two Years for Receiving Stolen Property

Richard Kozecar received his sentence in the Starke Circuit Court yesterday, having been found guilty in April of Receiving Stolen Property in a one-day trial. Kozecar was found in possession of a muzzle-loader after a burglary incident in Starke County last year.

Five witnesses were called to the stand including Kozecar himself and his brother for the defense during the trial.

Kozecar was sentenced to two years in the Department of Corrections with none suspended, but he can serve 12 of those months on home detention through Starke County Community Corrections. He is also required to pay restitution to the victim and has the right to an appeal.

Murder Suspect’s Court Date Delayed

A Second pretrial conference and plea agreement deadline date in the case of Kathleen Holt has been rescheduled for Thursday, July 11 at 8 a.m. in Starke Circuit Court.

The extension was requested by the defense last week in an effort to consider an evaluation to determine if Kathleen Holt is competent to stand trial. Court officials indicated that the jury trial has not been reset at this time.

Several Offenders Sentenced in Starke Circuit Court

Several sentencing hearings were held in Starke Circuit Court Wednesday.

Tiffany Woodard Wireman pleaded guilty in a plea agreement with the state in two different cases to charges of Visiting a Common Nuisance as a Class B Misdemeanor and Escape as a Class D Felony. On the misdemeanor charge, she was sentenced to 60 days in the Starke County Jail. On the Escape charge, she was sentenced to 18 months in the Department of Corrections with six months suspended to be served on probation. The sentences will be served consecutively. She had removed her electronic monitoring device while serving time with Starke County Community Corrections.

Trial for Virgil Noble Continues in Starke Circuit Court

The trial continues in the Starke Circuit Court for a man charged with rape and sexual battery following an alleged incident in 2010. Virgil Noble is facing those charges after being arrested after an incident involving inappropriate sexual contact with a Hamlet woman. Noble was arrested at his home on Dec. 28, 2010 on an active arrest warrant for the charges.

Recommended Plea Bargain for Miller Filed in Starke Circuit Court

A recommendation for a plea agreement has been filed in the case of former North Judson Clerk-Treasurer Connie Miller. Special Prosecutor Michael Krebes has filed the recommended plea agreement with the St. Joseph County Court in which Miller would plead guilty to three counts. Special Judge Jerome Frese took the recommendation under advisement.

The recommendation would sentence Miller to three years on each count to be served concurrently, and each of those sentences would be suspended to be served on probation. In addition, Miller would be required to pay court costs, probation fees, and serve one year on home detention through Starke County Community Corrections. She would also be required to pay $52,044 in restitution per a negotiated settlement with the Indiana Attorney General’s office.

One Day Trial Finds Defendant Guilty

A jury of six found Richard Kozecar guilty on one count of Receiving Stolen Property in a one-day trial in Starke Circuit Court Wednesday.

The jury found Kozecar was in possession of a muzzle-loader after a burglary incident in Starke County last year. Five witnesses were called to the stand including Kozecar himself and his brother for the defense.

Starke Circuit Court Judge Kim Hall will sentence Kozecar on the Class D felony on May 8 at 11 a.m. CT.

An Elkhart man was sentenced yesterday in Starke Circuit Court on a Class C felony charge of Intimidation and a misdemeanor count of Interference with Reporting a Crime.

Brent Komon, 25, pleaded guilty to those charges in a plea agreement with the State. Komon admitted to Judge Kim Hall that he and a Starke County woman had a disagreement on Oct. 31 and he threatened to take the life of the woman while armed with a loaded rifle. When she attempted to call the sheriff’s department, he admitted to the judge that he threw the phone at the TV and it broke, thus making it impossible for her to seek help from law enforcement.

Plymouth Man Sentenced in Starke Circuit Court

A man who admitted to threatening two North Judson police officers in an October incident was sentenced in Starke Circuit Court Wednesday morning.

Timothy Howard, 37 of Plymouth, told Judge Kim Hall that he had indeed threatened to physically harm two North Judson officers while the officers were doing their duty to investigate the incident in which he was involved. During the course of the incident, Howard threatened to damage a residence if the owner did not let him in the home. He proceeded to kicked dents into a door after his order was not carried out.

Jennie Carter Sentenced in Starke Circuit Court

Theft from a local entity will not be tolerated as proven by Starke Circuit Court Judge Kim Hall after he sentenced Jennie Carter on that charge in court Monday morning.

Carter was the defendant in a bench trial in February where, based on evidence and testimony, Judge Hall found her guilty of stealing $7,748.40 from the Starke County Tourism Commission.

A woman who was convicted of taking more than $7,000 in Starke County Tourism Commission funds for her own use will be sentenced in Starke Circuit Court this morning at 10 a.m.

Starke Circuit Court Judge Kim Hall found Jennie Carter guilty on a charge of theft after a bench trial. The prosecution called two witnesses: Chris Campione with the Indiana State Police, who was the lead investigator in the case, and Debbie Mix with the Starke County Chamber of Commerce and the Tourism Commission. They testified of their knowledge of the event surrounding the incident. Defendant Jennie Carter testified on her own behalf.

The bench trial occurred over the course of two days in February.

Several People Receive Sentences in Starke Circuit Court

The Starke Circuit Court was up to its ears in plea and sentencing hearings this week, as a number of people pleaded guilty to charges against them and received their sentences from Circuit Court Judge Kim Hall.

Priscilla Bodine pleaded guilty to Possession of a Controlled Substance as a Class D felony, while Timothy Bodine entered a guilty plea for Possession of a Controlled Substance and Receiving Stolen Property as Class D felonies. Priscilla was sentenced to 13 months in the Department of Corrections with the entirety of her sentence suspended to be served on probation. Timothy received a sentence of 14 months for both counts, and seven months was suspended for both counts against him; the sentences will be served concurrently. He will serve those seven suspended months on probation, while the executed sentence will be served on home detention with electronic monitoring through Starke County Community Corrections.

Matthew Bradley pleaded guilty on Wednesday to Theft as a Class D felony and was sentenced to 18 months in the Department of Corrections. His 18-month sentence was suspended with the exception of the 106 days he served in Starke County Jail. He will serve 12 months on probation.
