Continue readingThe Starke County Council members recently received a Notice of Claim from Tom DeCola who was expelled from his seat on the Starke County Council on Feb. 18.
DeCola claims that he was not given the full 30 days to respond to allegations of disorderly conduct and public intoxication during a “social event hosted by the Indiana Association of Counties” in Indianapolis. He stated that the deadline was technically Feb. 21 and he was asked to provide an explanation during the council’s meeting on Feb. 18. During that meeting DeCola had this comment, “After reviewing the paperwork that was handed to me, I read it and decided that it was my in persona civil cause of action and that it wasn’t an authoritative official cause of action. So, I decided it’s not even worthy to respond to it.”
DeCola also claims the Starke County Council wrongfully expelled him for allegations that were outside his term. He took office on Jan. 1, 2019 and the allegations occurred on Dec. 12, 2018. He said he wasn’t acting under any type of official duty and has not been criminally charged. He also claims the witnesses who gave statements were unreliable.
DeCola’s oath of office was filed on Dec. 7. Witnesses at the conference in Indianapolis stated he introduced himself as a Starke County Councilman.
Starke County Attorney Marty Lucas said the claim is currently under review.
In a press release, Starke County Council President Dave Pearman said the fiscal body may, by state statute, “(1) expel any member for violation of an official duty; (2) declare the seat of any member vacant if the member is unable or fails to perform the duties of the member’s office; and (3) adopt its own rules to govern proceedings under this section, but a two-thirds ( 2/3 ) vote is required to expel a member or vacate a member’s seat.”
Pearman stated that DeCola’s Notice of Claim will be discussed during the council’s next meeting on Monday, March 18 at 5:30 p.m. CT in the meeting room in the Starke County Annex Building No. 1 at 53 E. Mound Street in Knox.
The Starke County Fire Association members are currently reviewing the First Responder program operations.

The Starke County EMS base in North Judson will soon have a paramedic on duty around the clock. The county commissioners approved the expansion of Advanced Life Support, or ALS, service to that base immediately and to Grovertown starting Jan. 1. Knox already has 24-hour ALS coverage. The Starke County Commissioners will open bids this morning for work on three bridges and award at least one contract so work can begin immediately. A previously announced timeline for the emergency repair of the bridge over the Yellow River on County Road 700 East calls for construction to start tomorrow and conclude on Aug. 15. The road has been closed since a tree floating down the river struck the bridge supports this spring. The commissioners will also open bids for the replacement of the bridges on 900 south just west of 100 West over Bogus Run and on 800 East over Eagle Creek, just north of 50 South. Starke County Council members voted unanimously to reestablish two funds that were somehow discontinued by the state. Monday’s action on the cumulative capital development and cumulative bridge funds will allow the county to keep more of the property tax money it collects and spend money that is currently set aside. Council President Dave Pearman hopes this will soften the blow for the county when budget time rolls around.
The Starke County Commissioners want a better cost-benefit analysis before they agree to expand the advanced life support service offered by EMS.
Director Paul Matthewson wants to add a paramedic at the North Judson base. Doing so would allow the service to generate more money by transporting patients from IU Health Starke Hospital to other facilities. Right now the Knox EMS base is the only one with ALS coverage. Having a paramedic on duty at another base insures adequate county coverage if an ambulance is out of town.
The Starke County Council wants department heads to keep their budgets for the upcoming year in line with current spending levels. President Dave Pearman has told them to cut where they can.
“Definitely don’t bring us anything that’s an increase. It can’t be tolerated unless there’s a special circumstance. In that case we’ll meet with whomever wants to meet with us,” he says.
County officials have offered the Koontz Lake Volunteer Fire Department what they hope is a workable option to make sure they are able to respond in tandem with Starke County EMS to all medical calls. Members of the fire department took exception with the county’s policy to let Grovertown-based Medic 5 decide whether they need their assistance, saying the department has provided medical services to year-round and seasonal residents since its establishment in the early 1940s. Starke County Council President Dave Pearman, who is also a volunteer firefighter, says public safety is the county’s number one concern. He says the Koontz Lake Fire Department’s pagers can be programmed to get the EMS calls automatically. He says it will cost the township about $30 per pager.
Township Trustee Mark Allen called a meeting of fire department, EMS, dispatch, sheriff’s office, emergency management and county government representatives. “The whole purpose of this meeting wasn’t trying to point fingers at anybody. I think some people might have thought about that in the meeting, but it’s not the case. This was just a matter of everybody getting on the same page and working for what’s best for the township. At least now we have an option. Actually Dave had a good suggestion. That was never suggested before. That would have been great to know that,” Allen told WKVI news after the meeting. An economical and quicker solution may come to fruition regarding the radio communication issues in Starke County’s Oregon Township.
The radio tower atop of the Starke County Sheriff’s Department suffered extreme damage in severe storms in June and July and has static communication with Oregon Township and in the San Pierre area. Oregon Township Trustee Mark Allen had approached the Starke County Council this week with an idea for a solution, but the members tabled the issue for further discussion. Council President Dave Pearman explains that decision.
“That original motion basically died – not because we didn’t want to move forward and support the community. The reason why is we wanted to expand this and see if we wanted to look in other areas,” said Pearman.
The Starke County Council discussed the proposed hospital sale at their meeting this week. Council President David Pearman suggested that before any decision be made on the sale to IU Health LaPorte Hospital that a consultant needs to be secured to give the members some idea of what the facility is worth.
