Five offenders were sentenced in Starke Circuit Court Wednesday morning after pleading guilty to charges in individual plea agreements with the State.
Chase Miller pleaded guilty to a charge of Possession of a Controlled Substance as a Class D felony. Judge Hall sentenced Miller to 13 months in the Indiana Department of Corrections with that entire sentence suspended to be served on probation. If he successfully completes a drug rehabilitation program as determined by the probation department, he may petition the court for misdemeanor treatment of the charge. The State may object to that request.
Terry Ashton pleaded guilty to a charge of Possession of a Controlled Substance as a Class D felony where he was sentenced to serve 24 months in the DOC with 12 months suspended to be served on probation. He also pleaded guilty to a charge of Operating a Vehicle with a Controlled Substance in the Body. He was sentenced to serve two months in the Starke County Jail and that time was suspended. Those sentences will run concurrently and Ashton was permitted to serve his time with Starke County Community Corrections. He was ordered to participate in a substance abuse treatment program or any other rehabilitation program offered.
Brad Lovely pleaded guilty to a charge of Possession of a Narcotic Drug as a Class D felony. He was sentenced to serve 24 months in the DOC with the entire time suspended to be served on probation. He also pleaded guilty to a charge of Possession of Marijuana as a Class A misdemeanor. He was sentenced on that charge to 12 months in the Starke County Jail. All of that sentence was suspended to be served on probation. If he completes a substance abuse treatment program, he may petition his felony charge to be reduced to a misdemeanor charge. The State may object to that request.
Tiffany Witham pleaded guilty to a charge of Possession of Methamphetamine as a Class D felony. The 24-month sentence was suspended to be served on probation. During the course of the hearing, the charge was reduced to a misdemeanor. She must complete a drug rehabilitation program. One other case against her was dismissed by the State.
Ashley Brewer pleaded guilty to two counts of Possession of Methamphetamine, as a Class D felony. Judge Hall sentenced her to 18 months in the Department of Corrections on both counts and those sentences will be served consecutively. Those sentences were suspended and with all of the time to be served on probation. If she completes a drug rehabilitation program, she may petition the court for misdemeanor treatment. The State may object to that request.
