Railroad Township discusses potential impact of new Indiana township merger law

Railroad Township officials and residents discussed a new Indiana law governing township mergers, and how it could potentially affect the township.

Under the new law, Senate Enrolled Act 270, new criteria is established that will determine whether certain Indiana townships will be required to merge with another township.

During the Railroad Township Trustees meeting on Sunday, attorney Marty Lucas shared that the new law establishes that Indiana townships will receive points based on several factors related to operations. A township that receives four or more points will be considered a designated township and will generally be required to merge with another township.

A preliminary assessment indicates that with current information available, Railroad Township would currently receive one point. However, this assessment is preliminary and the township has not yet received an official score.

Even if Railroad Township is not designated, officials discussed the possibility that the new law could still affect the township if a neighboring township is required to merge.

Railroad Township borders both Jackson and Wayne townships. Lucas explained that a designated township would be required to merge with an eligible recipient township with three or fewer points, meaning the scores of neighboring townships could become relevant to Railroad Township.

During the discussion, Lucas talked about the fact that the new law allows for affected townships to voluntarily work out a merger; giving township officials an opportunity to determine how the consolidation would work. If required mergers are not resolved voluntarily, county commissioners would ultimately determine which township governments will merge.

One of the other large topics of discussion in regards to potential mergers is what it could mean for fire protection for Railroad Township. Meeting attendees asked about the future of fire services, equipment, and existing contracts if the Township were to merge.

Railroad Township currently contracts with the San Pierre Fire Department.

Meeting attendees also discussed the importance of maintaining local input if consolidation becomes necessary.

For the time being, no merger involving Railroad Township has been proposed or approved.

The Indiana Department of Local Government Finance is required to publish the initial township scores by December 31st of this year. Townships receiving four or more points will have until March 31st, 2027 to request reconsideration of their scores, with a final list of designated townships due by July 1st, 2027.
