Two Knox men face felony charges after an alleged rape incident on Sept. 19 at a Knox residence.
According to the charging information filed in Starke Circuit Court, 58-year-old Samuel Allen, is accused of having intercourse or sexual conduct with an unconscious woman on the night of Sept. 19. He faces felony charges of rape and sexual battery as well as a misdemeanor charge of criminal recklessness.
The police report states that the woman was found slumped over the steering wheel in her car and foaming at the mouth, indicating a drug overdose. The paramedics were called to the scene where they could not locate a pulse. The medical responders administered NARCAN and later received a pulse.
Upon further investigation, the police report states that an officer with the Knox City Police Department noticed signs of possible rape as emergency personnel attempted to revive the woman. After a pulse was retrieved, the woman was later transported to Memorial Hospital in South Bend where a rape kit was collected for evidence in the case.
It is alleged that the incident occurred inside a residence on Locust Drive in Knox and Allen had assistance in moving the unconscious woman from the home and into the car. Dean Hamilton, 56, is charged with that alleged action and faces a felony charge of assisting a criminal and a misdemeanor charge of criminal recklessness.
An initial hearing was held in Starke Circuit Court on Sept. 28 where Blair Todd was appointed counsel for Samuel Allen. Allen requested a speedy trial. A trial date was set for Jan. 9, 2019.
Allen remains in the Starke County Justice Center with a $500,000 bond and a no contact order with the victim.
Hamilton appeared for an initial hearing on Sept. 28 where Blake Dahl was appointed counsel in his case. Hamilton also requested a speedy trial with a trial date set for Feb. 13.
