Starke County Jury Finds Knox Man Guilty on Child Molesting, Incest Counts

It took just over two hours for a Starke County jury to return verdicts Friday afternoon on 10 counts filed against Knox resident, 43-year-old Elven McCarty.

According to the amended criminal information filed in Starke Circuit Court, McCarty was charged with child molesting, incest, sexual battery and sexual misconduct with a minor in varying felony degrees during a period of time spanning between 2010 and 2017.

After the three-day trial concluded, the jury found McCarty guilty on charges of two counts of child molesting as a Class A Felony, three counts of incest as a Class B Felony, child molesting as a Class C Felony, one count of incest as a Level 4 Felony and sexual battery as a Level 6 Felony.

He was found not guilty on one count of sexual misconduct with a minor as a Level 4 felony, and one count of incest as a Level 4 Felony.

Twelve members served on the jury as well as three alternates. John Thompkins of Indianapolis was McCarty’s defense attorney in the case while Chief Deputy Prosecuting Attorney Mary Ryan represented the State of Indiana.

McCarty was remanded to the custody of the Starke County Sheriff’s Office following the reading of the verdicts where he will stay until his sentencing hearing on Thursday, Feb. 21 at 9 a.m.
